Duncan v Walshe

A lorry and a motorcycle were travelling in opposite directions along an A road. The lorry executed a right turn manoeuvre into a minor side road. In doing so, he straddled both carriageways and, as a result, the motorcycle collided with the lorry.

It was not established that the motorcycle had been travelling at excessive speed at the time of the accident.
