Hit from behind at roundabout

We were instructed by Amanda in February 2019 in relation to a motorcycle accident that she had when riding her Honda Grom MSX 125 back home from work. Amanda, 24, had been riding a motorcycle since she was sixteen years old.

Whilst waiting stationary to enter a roundabout in Aberdeen, an Aberdeen City Council minibus collided with the rear of her motorcycle causing her to be thrown over the handlebars and onto the road. Amanda suffered nasty injuries to her hip and back. She was off work for three weeks. By coincidence, she was also employed by Aberdeen City Council.

We were delighted to be instructed by Amanda and duly intimated her claim to the insurers for Aberdeen City Council. They quickly admitted responsibility for the incident but refused to make her an appropriate offer in light of her injuries and her losses. Because the insurers refused to make an offer that we could recommend to Amanda, we required to raise her case at The All Scotland Personal Injury Court in Edinburgh. During this time, the solicitors instructed by the Council simply maintained their previous offer to Amanda notwithstanding the seriousness of her injuries. A Proof date in her case was fixed for September 2020.

Due to the Coronavirus pandemic, the Courts in Scotland are not generally hearing civil cases in person. Instead, a new system has been implemented to allow for witnesses to give evidence in their case over the internet by video link from their own home. This is a huge change in how Proofs have been heard in Scotland, however, Motorcycle Law Scotland welcomes this new development as it allows our clients cases to still proceed and indeed for our clients to give their evidence from the comfort and safety of their own home.

In the end, just a few days before Amanda’s case was due to start at Court, we received an increased offer over three times higher than what had initially been offered to her by the insurers. We were delighted that Amanda had held her nerve and trusted us to get her the best result.
