Davis v Swinwood

A car driver brought an action against a lorry driver following a collision when he exited a minor road into a major road.

The lorry driver was displaying a left hand indicator, had positioned on the road as if to turn in and was travelling at low speed.

The Court found that the lorry driver was indicating left but determined it wasn’t relevant to the issue.

The car driver was entering onto a major road and the lorry driver was proceeding on that major road.

The car driver was 100% at fault
