Lindsay v Lamb (2007)
A motorcyclist was proceeding on an A road. A Toyota driver had sustained a puncture and was stationary in the nearside lane.
Three vehicles behind the Toyota braked without incident. The fourth vehicle braked but was unable to stop and collided with the car in front. A following scooter rider was struck by a lorry travelling behind him and thereafter struck the fourth vehicle. The lorry also hit the fourth vehicle.
The lorry driver was to blame for the accident as he struck the scooter which was then projected into the rear of the fourth vehicle. The lorry driver failed to observe the position of the scooter and leave sufficient distance. The scooter rider was 20% to blame for failing to steer his vehicle into a position where he could have avoided a collision with a car in front.
