Motorcycle collision circumstances
On 7 May 2018, Ian was riding his Suzuki Intruder 1400 motorcycle home through Newburgh in Fife. As he was riding though the village, a car swung out from a parking bay outside the local Co-op shop. Ian was unable to avoid a collision and was thrown from his bike, into the car and then onto the road.
Personal injuries and motorbike damage
Ian suffered a serious injury to his shoulder, neck and back and his bike was written off. He is self-employed in property maintenance and was unable to work whilst he recovered from his injury. His primary concern was that he had no income whilst he was injured.
Independent assessment of his motorbike
Ian approached Motorcycle Law Scotland after he was struggling to agree a fair settlement with his insurers for his written-off motorcycle. We were able to arrange for a specialist engineer to assess his motorcycle and for a fair settlement to be made by the insurers of the car that had caused the collision, rather than through his own insurers. This meant that there was no insurance excess deducted from the value of his motorcycle.
Interim payment and rehabilitation services arranged
Given that his injuries were affecting his income, we were able to arrange for interim payments to be made to him to assist him with his finances and therefore allow him to focus on his recovery. We had the third-party insurers pay for local physiotherapy treatment and massage therapy to maximise his recovery and we instructed a specialist orthopaedic surgeon to assess his injuries before negotiating a settlement which Ian was very happy with.
